Acceptance of terms

By installing or using Stackable ("the app", "the service"), you agree to these Terms of Service. If you do not agree, do not install or use the app.

The service

Stackable is a Shopify app that lets merchants configure bulk and volume discount campaigns - volume/tiered pricing, BOGO, quantity breaks, and scheduled sales - computed server-side by Shopify Functions so they apply consistently in cart, checkout, and accelerated checkout.

Accounts and eligibility

You must be an authorized administrator of a Shopify store to install Stackable, and you access the app through Shopify's standard OAuth flow. You are responsible for activity that happens under your store's Stackable account, including actions taken by your staff.

Billing

Stackable is billed through Shopify's billing system, on the plan you select inside the app. Our pricing meter is the number of concurrent live campaigns your plan allows - never a percentage of your revenue and never gated by your underlying Shopify plan. Current pricing is shown on our Pricing page and inside the app before you confirm a plan change.

Charges, trials, and proration are processed by Shopify on our behalf, per Shopify's own billing terms.

Acceptable use

  • You will not use Stackable for any unlawful purpose or in a way that violates Shopify's own Acceptable Use Policy or Merchant Terms of Service.
  • You will not attempt to reverse engineer, decompile, or circumvent the app's billing or access controls.
  • You will not use the app or its APIs in a way that abuses shared infrastructure or degrades service for other merchants.

Intellectual property

Stackable owns the app itself: its software, source code, design, branding, and documentation, along with any improvements we make to them. Using the app does not transfer any of that ownership to you. Except for the limited right to use Stackable as intended under these terms, we reserve all rights not expressly granted.

You own your content and data - the discount campaign configuration, store settings, and any other material you create or upload in Stackable, as described in "Your content and data" below.

Your content and data

You own the campaign configuration and store data you create in Stackable. We process it as described in our Privacy Policy and Data Processing Addendum, solely to provide the service to you.

Availability and changes

We work to keep Stackable available and reliable, including during high-traffic periods like BFCM, but we do not guarantee uninterrupted availability. We may modify, add, or discontinue features; where a change is material, we will make reasonable efforts to notify merchants in advance via the changelog or email.

Warranty disclaimer

Stackable is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any specific business outcome, revenue increase, or conversion rate from using the app.

Limitation of liability

To the maximum extent permitted by law, our total liability arising from or related to these terms or the service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data, even if advised of the possibility.

Indemnification

You agree to indemnify and hold Stackable harmless from any claim, loss, or expense (including reasonable legal fees) arising from your use of the app in violation of these terms, your violation of applicable law, or content or data you provide that infringes a third party's rights.

This clause is a standard SaaS placeholder and has not yet been reviewed by counsel - confirm scope (one-way vs. mutual) and any carve-outs before launch.

Termination

You may uninstall Stackable at any time from your Shopify admin. We may suspend or terminate access for violation of these terms. On termination, your data is handled per the retention terms in our Privacy Policy (including the shop/redact deletion described there).

Governing law

These terms are governed by the laws of the United States, without regard to conflict-of-law principles, except where applicable local law requires otherwise. Final governing law and venue will be confirmed with counsel before launch - treat this section as a placeholder until then.

Changes to these terms

We may update these terms from time to time. Material changes will be reflected in the "Last updated" date above; continued use of Stackable after a change means you accept the updated terms.

AI-assisted features

Stackable includes optional AI-assisted features, including the campaign assistant and Scripts Rescue, that generate draft discount campaigns from input you provide. To produce a suggestion, the text you type or paste is sent to our AI sub-processors, as described in our Privacy Policy and Data Processing Addendum.

AI-generated suggestions are provided for your convenience and are a starting point only. They may be incomplete or incorrect, and we do not warrant their accuracy. You are responsible for reviewing, verifying, and testing any campaign - including in the built-in simulator - before you publish it, and for the campaigns you choose to publish.

These features are for configuring discounts. You agree not to submit customer personal data or other confidential information you do not want processed by our AI sub-processors. We may change, limit, or discontinue the AI-assisted features at any time.
